WHAT IS FLEXIBLE COMPENSATION?

It is regulated under Law 35/2006 of November 28 on Personal Income Tax (IRPF) and Royal Decree 439/2007 of March 30, which state the following:

  • Flexible compensation may not exceed 30% of the employee’s total salary and cannot reduce the amount of money received below the minimum wage (SMI).
  • The implementation of flexible compensation only affects the employee’s income tax (IRPF), and under no circumstances will it affect the employee’s social security contribution base.
